NEW YORK (TheStreet) -- The market has continued to shake off negative headlines and fears in its march higher. TheStreet's Jim Cramer and Brittany Umar discuss the current investing environment.

The S&P 500 is trying to close positive for the eighth consecutive day, something that it did in July. Cramer said when that happened, the market slowed down for a couple of sessions, before continuing higher.

However, the usually optimistic Cramer said this current environment is a little too bullish for him, especially with the weakness in apparel and the financials' inability to decline, even though there have been fewer bank loans.

Historically, "the levels I like to be involved in, are not here," he added. Although Cramer may not like the current level for stocks, that doesn't mean he is a seller or is expecting a sharp decline. When asked whether it was time to trim, Cramer only said that he is not a buyer and does not want to put new money to work.     Bank of America Corp. (NYSE: BAC) is one of the banks that has scaled back mortgage refinancing operations significantly. While the acquisition of Merrill Lynch has been a tremendous boost to the top and bottom line, the company still faces litigation over mortgages and practices.     Still, flagging mortgage activity could prove to be problematic for Wells Fargo. Last quarter, mortgage originations fell by 16%, and the big rise in rates could push those levels downward even further. Yet Wells has a big advantage over Bank of America (NYSE: BAC  ) and JPMorgan Chase (NYSE: JPM  ) in that it has seen delinquency rates and foreclosure ratios that are much lower than those of its competitors. B of A's delinquency rate was about double that of Wells Fargo, and Wells came in more than 30% lower than JPMorgan's delinquency rate. Loan quality should be able to help Wells weather the mortgage storm better than its rivals.

    The year ahead should be a great one for the smaller bank stocks. Larger regionals like Huntington Bancorp (HBAN) and Capital Ban Financial (CBF) have made it clear they intend to grow by acquisition in the years ahead. Banks like First Merit (FMER) and First Merchants (FRME) have done deals in the past year and are open to doing more to increase their market share and footprints. This should be the year the floodgates open and we see the first wave of merger activity in small banks.
